How do I know if I am facing federal charges?
This is not always an easy question to answer. If you are incarcerated at a federal facility, then you are obviously charged by the federal government. However, the federal government may hold you at a state or local facility or may not have even notified you that you have been charged with a crime.

A good rule of thumb is that if a federal agent (FBI, DEA, etc.) has talked to you, you are at least under investigation and may be charged by the federal government. The Criminal Defense Group can easily check whether you are in the federal court system.
I have been approached or asked questions by federal agents. What should I do?
Before talking to anyone, immediately hire a federal defense attorney. If this is not possible, you must be extremely careful not to incriminate yourself. When it doubt, it is advisable to exercise your Fifth Amendment rights not to answer a question until you have consulted with an attorney. Whatever you do, do not lie.
What are the steps in the federal process?
The federal government will often start a criminal investigation long before any charges are filed. These investigations can sometimes go on for years before you are notified to appear in front of a Federal Magistrate to hear charges filed against you.

It is important to get the assistance of a federal lawyer as soon as you even suspect that you are under investigation. Most defendants get private defense counsel after their initial appearance or a court-appointed public defender after their arraignment.

The next step is the Arraignment. Following the arraignment is a period of discovery and trial preparation. A skilled defense team will use this period to make pre-trial motions intended to either dismiss the case or mitigate the charges.
